Private International Law Commission Mid-year internal meeting

On July 7 2018, the Private International Law Commission held in Milan (Italy) a mid-year internal meeting in order to prepare its session at the Porto Congress about Private International Law Best Practices in Cross-Border Dispute Resolution, that will be held on November 2 2018 from 9:00 to 12:30 in Centro de Congressos da Alfândega do Porto - Room D. Maria.

For the first part of the session, dedicated to the beginning of the proceedings and procedural strategies, certain subtopics have been selected with the aim of analyzing how they work in ordinary judicial proceedings and in arbitral proceedings. In particular, during this part of the session, the speakers will deal with matters concerning parties to be involved, contents of document instituting the proceedings, jurisdiction of the seized court or arbitral tribunal, parallel proceedings, negative declarations, torpedo actions, mix between litigation and arbitration.

After the coffee break, during the second part of the session dedicated to implementation of the strategies, the speakers will focus on further hot issues, such as service of the documents instituting the proceedings (translations, way to perform the service, etc.), taking evidence (domestic and cross-border) and interim measures.

Using case studies and various contributions by speakers coming from different jurisdictions, we will therefore discuss those crucial points with the aim to provide a platform for exchange of experiences among all participants and to identify some best practices on this subject.
