Tapping of telephone calls between lawyers and their clients in the Netherlands

On October 27, 2015 the Court of Appeal of The Hague upheld an earlier decision of the District Court to stop the tapping of telephone calls between lawyers and clients by the Dutch Intelligence and Security Service (AIVD).

Lawyers of the Amsterdam law firm Prakken d’Oliveira complained about the tapping of telephone calls between them and their clients. The Review Committee for the Intelligence and Security Services (CTIVD) submitted an opinion to the Dutch Minister of the Interior and Kindgdom Relations declaring the complaints partially unfounded and partially well-founded insofar they concerned indirect tapping. Indirect tapping is tapping a suspect that calls with a lawyer. Direct tapping is tapping the lawyer self.

Le secret des confidences faites à l’avocat

La Cour suprême du Canada a rendu en février 2015 un très important arrêt déclarant illégale la législation qui avait pour effet de forcer les avocats à dénoncer certaines activités de leurs clients ; la Cour en est arrivée à la conclusion qu'il s'agissait d'un accroc à une règle fondamental de justice.

Ce sujet sera traité dans un cadre plus large lors de la réunion du Sénat International des Barreaux à Budapest le 29 octobre 2016.

Une décision très étonnante de la CCJA

La Cour Commune de Justice et d’Arbitrage de l’OHADA a rendu un arrêt en date du 19 novembre 2015 qui interpelle le monde de l’arbitrage, en annulant une sentence arbitrale pour dépassement de mission en raison d’une fixation des honoraires des arbitres, en accord avec les parties, mais sans accord formel de la CCJA. Cette décision soulève la question de la double mission de la CCJA, organisme organisateur de l’arbitrage et juge d’appel de la sentence.

État d’urgence en France, la profession doit rester vigilante

En réunion à Paris début décembre, l’UIA a rencontré les instances ordinales françaises au moment où le débat sur l’État d’urgence en France agite la profession d’avocats. Le Bâtonnier du Barreau de Paris, Frédéric Sicard, aux côtés de Dominique Attias, Vice–Bâtonnière, ont de concert souligné la place essentielle que peut occuper l’UIA sur ces questions qui touchent désormais plusieurs pays étrangers. Le développement des activités de l’avocat

Le président Uettwiller s’est rendu à Sofia les 26, 27 et 28 novembre 2015, à la demande des barreaux bulgares pour appuyer leur demande de modification de la loi sur les avocats et la constitution afin d’accroître les compétences des avocats et de leurs institutions. Il a rencontré à cette fin le ministre de la justice et le président de la commission des lois du Parlement. Depuis, la modification de la constitution a été définitivement adoptée. Il reste en débat la modification des activités de l’avocat qui se heurte à l’opposition des notaires. L’UIA a proposé une table ronde interprofessionnelle pour tenter de dégager une solution.

The German Federal Bar Country Report 2015 - Germany

The German Federal Bar (Bundesrechtsanwaltskammer) is the umbrella organization of the 28 regional Bars in Germany (Rechtsanwaltskammern). It acts as a central organization for the legal profession in general and represents all lawyers in Germany (around 164,000). In Germany, every lawyer is a mandatory member of a regional Bar. Therefore, The German Federal Bar safeguards the professional interests of all lawyers in Germany at a federal, European and international level. (read more...)

The UIA condemns Murder of Lead Lawyer Tahir Elçi

The UIA urged Turkish authorities to ensure that the investigation into Mr. Tahir Elçi’s murder is independently and impartially conducted. All necessary steps should be taken adequately to bring to justice those responsible, in accordance with international standards. (read more...)

Charges against Human Rights Lawyer Khin Khin Kyaw

The UIA wrote to authorities of Myanmar to express concern about the situation of Ms. Khin Khin Kyaw human rights lawyer and member of a legal team representing more than 50 detained student protesters against Myanmar’s National Education Law. Ms. Khin Khin Kyaw was charged with disrupting the court proceeding, under Section 228 of the Penal Code. She is facing up to six months in prison, fines, and revocation of her legal license. Avocats chinois - action conjointe

A l’initiative de l’ACAT, Me Jean-Jacques Uetwiller, Président de l’UIA, s’est joint à 19 avocats, juges et juristes, dont Robert Badinter, ancien garde des Sceaux français, et Manfred Nowak, ancien rapporteur de l'ONU sur la torture, pour signer une lettre ouverte adressée au président Xi Jinping exprimant leur préoccupation à propos de la répression des avocats en Chine (lire plus...).

The Assembly of States Parties to the Rome Statute of the International Criminal Court met for its 14th session in The Hague, 18-26 November 2015. International Arbitration Commission: the 2015 “Commission of the Year

The International Arbitration Commission is very proud of the award it was granted at the Valencia congress for its work in 2015. This award rewards the quality of the work of an efficient team under the chair of Patricia Peterson. This team, composed of Laurence Kiffer, Veit Öhlberger, Alvaro Lopez de Argumedo, Jane Willems and not the least Andrea Carlevaris, took the lead of this commission in Dresden with the organization of the first session at the congress in Macau which was devoted to arbitration in Asia. In addition to its activity during the annual congress, as from 2013, the commission was involved in a training activity in Senegal. (read more...)

UIA Women’s breakfast in Venice

Venice will host UIA’s next Governing Board meeting on February 20, 2016. On this occasion, the UIA Women’s network will be organizing its traditional networking breakfast.
