Fortress Europe or Level Playing Field?
Non-EU entities wishing to do business in the EU under closer scrutiny.
Certain acquisitions of EU-based companies by non-EU entities have raised concerns on security and public order grounds. In response, a growing number of EU Member States have put in place screening mechanisms for certain strategic investments, with the EU playing a coordinating role. These Foreign Direct Investment (FDI) regimes add an additional layer of complexity to M&A transactions within the EU. More recently, the EU has also addressed the concern of subsidies granted by non-EU countries that distort the EU internal market and fair competition within the EU. With its Foreign Subsidies Regulation (FSR), the EU has put in place tools to tackle non-EU subsidies causing such distortions. A panel of experts will discuss how these new regulatory regimes work in practice and how they impact businesses and transactions.
