The UIA Bankruptcy Law Commission could be considered to be one of the commissions with the greatest international involvement, as the insolvency of a company in one country affects its affiliates, suppliers, workers and creditors in other countries.

Moreover, the Commission's work is closely tied to that of other commissions, primarily the Litigation Commission, the Foreign Investment Commission and the Corporate Law Commission, as well as, to an increasing extent, the Family Law Commission.

It is precisely for this reason that the Commission has taken an active part in the United Nations Commission on International Trade Law (UNCITRAL), Working Group V (Insolvency Law) since 2008, by putting forward its practical point of view to the international law maker.? The Commission was also involved in previous work through its members and continues to attend the sessions that are held in Vienna and New York every six months.

This is why attorneys from all over the world contribute to the Commission's work and give their personal input on Bankruptcy Law.

The Bankruptcy Law Commission takes an active part in the annual congress held by the UIA, providing speakers to other committees that deal with matters related to insolvency and holds a monographic session with local specialists who usually work in different bankruptcy law jurisdictions.

In addition, each year the Commission invites a specialist, usually a judge from the country where the Congress is held, who gives a presentation that focuses on insolvency in his/her home country, so that over the years the Commission members have a better understanding of the situation in each country.

During the year the Commission holds two meetings, which are always well-attended. The Commission also publishes newsletters that report on its latest activities and present the scientific work that completes the existing documentary database.?

The Commission also publishes reports from specialised journals.

Ultimately, the Commission conducts its work through its members, all of whom are specialised in bankruptcy law, but remains open to all other professionals from around the world who are interested in this subject.

    Personal Liabilities out of Insolvency - Liability of Company's executives in Mexico

    In regards to the management of business at a global level there are many laws, regulations, public and private institutions, as well as universities that promote the culture of best practices of corporate governance, however, there continue to be cases of insolvency of companies due to their mismanagement in the absence of proper rules of corporate governance.

    When an insolvency proceeding is filed, harm may be caused to the company due to inadequate management by their executives.

    In view of this situation, in 2014, the Mexican legislator introduced some reforms and additions to the Bankruptcy Law that regulate the liability of executives in cases of companies undergoing an insolvency proceeding.
