The food industry is constantly inventing both new foods and new ways to advertise foods. This is due, in part, to advances in science that now allow for humans to change the genetic make-up of foods – either through genome editing with CRISPR or inserting a completely new gene from another species into a plant to create a genetically modified organism. It is also seen in new foods such as beer or wine that has 0% alcohol; meat made entirely from plants or grown in laboratory from cells; or zero sugar foods. Further innovation is emerging in the use of nanotechnologies in food production, packaging and preservation (for example to improve nutrient delivery, shelf life or food safety).

But new foods (and new means of advertising foods) bring new difficulties and perils for food companies and attorneys that advise them. The regulatory landscape for both new foods and new methods in advertising those foods is rapidly changing, and differs from country to country, creating challenges for food companies to navigate as they bring new foods to market. In parallel, companies developing novel foods must consider how to protect innovation through patents, trade secrets and branding strategies, while ensuring that product names, marketing claims and packaging comply with food labelling and advertising rules. This seminar shall explore several types of new foods and the regulatory landscape that governs these foods. This seminar will also focus on new means of food delivery and advertising and provide practical insights on how to navigate the legal regulations that govern. Attention will be given to the legal challenges arising when emerging food technologies intersect with advertising rules, consumer protection and intellectual property frameworks.

The registration programme will be available soon.
