“Civil Society’s Perceptions of the Legal Profession: How can they be improved?"

Regard for and the reputations of lawyers and the legal profession have almost never lower. In many parts of the world lawyers are seen largely as mouthpieces for the powers that be. In other instances they are seen as way too costly, as having priced themselves out of reach of ordinary people. What can Bar Associations and their members do to right these misperceptions and exaggerations? How can we enhance and promote the rule of law and the role of volunteer lawyers, legal aid and the like?

“The Wellbeing of the Lawyer”

Lawyer wellbeing has become an crucial topic for bar associations across the world. For example, the Bar Council and Law Society (England and Wales); the Canadian Bar Association; the American Bar Association; and many local and provincial bars are actively recommending that attorneys attend to their own wellbeing and the wellbeing of their partners, associates, and staff.  Much of this impetus is based on alarming statistics with respect to high levels of substance abuse, depression, anxiety, and stress among lawyers.

In this post-pandemic era, many lawyers increasingly are choosing to work from home. Benefits include saving on travel time, more and better family time, and more flexibility in general.

But are there downsides to consider? Loss of mentoring for younger lawyers, less opportunity for creative working sessions with colleagues and less collegiality with colleagues generally.

The UIA – together with other lawyers’ organisations such as the CCBE – actively participates as an observer in the work undertaken by the Council of Europe's Committee of Experts on the Protection of Lawyers (CJ-AV) towards drafting an international convention aimed at strengthening the protection of the legal profession and the right to practice the profession without prejudice or restraint.

Pro bono law services have never been more needed and our Bar Associations have never had a greater opportunity to help fill that need. In helping to fill the need for pro bono work, Bar Associations can simultaneously help many younger attorneys gain valuable hands-on experience working directly with clients, appearing in court and so on.

Open Forum UIA pour Leaders des Barreaux

Le Sénat international des barreaux (SIB)
Il est l'un des rares espaces de rencontre entre Bâtonniers, permettant l’avancée du droit au niveau international et le dialogue entre instances professionnelles. Le SIB favorise la construction, la progression et les modifications des politiques professionnelles en relation avec les principes essentiels de la profession.
✓ Par exemple : réflexions sur l’établissement d’un Code mondial de déontologie ou sur la lutte contre les violations du secret professionnel.

Les sommets UIA des présidents de barreau à l’ONU
Des rendez-vous uniques pour rencontrer dans un lieu hautement symbolique confrères et représentants d’associations internationales. Ces sommets permettent de se tenir informés des débats en cours aux Nations Unies sur le thème du droit international et de rencontrer des experts mondiaux sur de nombreux sujets.

Les actions de l’UIA favorisent l’échange d’expériences entre barreaux et organisations d’avocats du monde entier pour contribuer au développement du droit au niveau international.

 

Les barreaux membres de notre organisation peuvent contribuer à l'établissement d'un ordre juridique international basé sur les principes de justice et d’équité entre les nations. Nous aidons également nos membres à comprendre les défis auxquels la profession juridique est confrontée au niveau international et l'organisation des instances dirigeantes professionnelles. L'un de nos principaux objectifs est de défendre les avocats et à protéger leurs droits à exercer le droit.

Les Barreaux du monde entier rejoignent l'UIA pour:
  • Contribuer à la construction et à l’entretien d’un réseau relationnel facilitant la rencontre de confrères de barreaux et d’organisations du monde entier.
  • S'impliquer dans les actions menées pour les droits de l’homme, la défense des avocats et de l’État de droit.
  • Soutenir les barreaux de jeunes démocraties ou de démocraties en difficulté dans les pays où la pression sur le système juridique est fort.
  • Rendre visible les actions menées par les barreaux grâce aux relais de l’UIA et à ses moyens de communication dans le monde entier.
  • Etre en lien avec les instances internationales (ONU, CPI, ABCPI, Conseil de l’Europe), véritable opportunité pour les barreaux de faire entendre leur voix sur la scène juridique internationale.
  • Participer à la publication d’ouvrages juridiques ainsi qu’aux résolutions et chartes ayant trait aux problématiques juridiques internationales.
  • Bénéficier de la formation continue par l’organisation de séminaires et conférences impliquant le barreau hôte et ses membres, dans des formations à caractère international sur des thèmes d’actualité.
