Human Rights and Protection of lawyers

The UIA pays special attention to the protection of human rights and the defence of their universal nature.

It works actively to protect the right of all lawyers to be able to practise their profession with full freedom and independence, without any hindrance, intimidation, harassment or interference in their professional duties.

Finally, the UIA closely follows developments in international criminal justice through its status as member of the Advisory Panel within the two International Criminal Tribunals and its participation to the work of the International Criminal Court.

This website presents UIA’s most recent activities in the field of human rights, the protection of legal professionals and international criminal law.

UN General Assembly adopts third resolution on global health and foreign policy UNITED STATES

On Thursday, 9 December the UN General Assembly adopted resolution A/65/L.27 on the issue of global health and foreign policy.
The resolution was passed following presentations by Brazil, representing the group of countries who comprise the initiative of global health and foreign policy (Brazil, France, Indonesia, Norway, Senegal, South Africa, and Thailand), Belgium, representing the EU, India, representing the Asian countries, Vietnam, speaking on behalf of the ASEAN member states, Switzerland, the USA, Japan, Australia, and the Holy See.

Firmin Yangambi sentenced to death CONGO (DEMOCRATIC REPUBLIC)

Lawyer Firmin Yangambi,who is a member of the Kisangani Bar and president of a NGO group called “Peace on Earth”, was sentenced to death by the military court of LA Gombe in Kinshasa for possessing weapons and attempting to build a rebel movement.

In a letter addressed to President Kabila,the UIA expresses its deep concern regarding his situation. The court also pronounced heavy prison sentences for his consorts Colonel Elia Lokundo, Eric Kikunda and Benjamin Olangi.

The UIA condemned Troy Davis's execution. UNITED STATES

The UIA strongly condemned Troy Davis’s execution in the US State of Georgia on September 21st 2011. Opposed to the death penalty, the UIA had followed Troy Davis’s case due to the several doubts arising around his accusation, which undermined the application of this sentence.

World Day against the Death Penalty

In 2003, UIA adopted the Resolution on the Abolition of the Death Penalty by virtue of which it reaffirmed its commitment to the advocacy of an international order governed by the rule of law and the respect of human rights, the most important of which is the right to life.

Since 2003, 18 States abolished the death penalty for all crimes . One State abolished it for common law crimes.

The number of abolitionist countries for all crimes thus went up from 78 at the end of 2002 to 96 at the end of 2010.

Call for an end to persecution of human rights lawyers in Iran and release of Nasrin Sotoudeh. IRAN

The UIA,in a joint appeal with several NGOs,asked the Iranian authorities to interrupt the measures which prevent lawyers of human rights defenders from working freely to assist Iranian citizens.
The Iranian lawyers are subjected to various form of harassment, threats or arbitrary detention, notably lawyers Mohammad Dadkhan, Dr. Hadi Esmailzadeh, Fatemeh Soltani and Gheyrat.

In Colombia, human rights defenders are currently subjected to threats, intimidations, disappearing acts, attacks, torture, assassinations, illegal home-searches of their domicile and of their worksites and stigmatizations because of their cares on human rights. The perpetrators of these crimes are often paramilitary groups who claim to be supported by the currently government. The UIA took part to the second ”Caravan de Juristas” in Colombia, which is an international lawyers’ delegation/commission with the aim to assess the situation of human rights defenders in Colombia and to bring their support to their action in favour of human rights.

The UIA participated in a roundtable about Human Rights’ Defence and Defenders, entitled“Lawyers at service of Lawyers”, which was organized by the International Observatory of Lawyers at the Maison du Barreau, in Paris on November, 14.

Firstly, speakers representing different bar associations, professional associations and NGOs addressed the subject of human rights lawyers’ training. They put emphasis on the necessity of adapting to the context et to ensure post-training monitoring.

Syria: Disciplinary procedure against Radeef Moustafa does not lead to disbarment

UIA heard with satisfaction that the disciplinary procedure held on April 3, 2011 against Radeef Moustafa by the Bar of Aleppo only resulted in a warning against him.
Mr Moustafa risked permanent disbarment for, among other “inciting to sectarian or ethnic divisions” and “belonging to a non-authorized organization”.

Mr. Moustafa leads a human rights organization (Al Rased) and regularly publishes on human rights violations.

Arrest of Mr. Francisco Luemba, lawyer member of the UIA

Francisco Luembais a lawyer and member of the UIA. He is a human rights defender who participated in peace talks between separatist guerrillas and the Angolan government. On June 17th 2010, he was arrested in Cabinda, a few days after the armed attack on the Togolese football team by separatist rebels. He was held incommunicado for 10 days, without access to his lawyer. In March 2010, he was charged with unspecified “crimes against the security of the State”.

The third edition of the Caravana Internacional de Juristas took place from August 26 to September 2, 2012 .

A delegation of over 40 lawyers from over ten countries visited different parts of the country in order to assess the condition of human rights defenders, especially lawyers, as well as the independence of the judiciary.

Situation of Syrian lawyers

In the framework of protests which started on March 2011 in Syria, the situation has only worsened for lawyers defending human rights there.

Over the last few months, dozens of lawyers have been arbitrarily imprisoned by the security forces for publicly condemning the violent and systematic repression by the regime against peaceful demonstrators, several of whom are their colleagues.

The «Caravana de Juristas » denounces the grave situation of human rights lawyers in Colombia

August 2008, an international delegation of lawyers went to Colombia to investigate the treatment of human rights lawyers in this country. In the Law Society of England’s report, the observers denounce more than 400 homicides since 1991 and many threats, harassments and disappearances to which human rights advocates are subjected.

The UIA expressed its concern to the President of Supreme Court about the difficult conditions the Colombian lawyers are facing while practising and its will to take constructive action to support these lawyers.

Justice Maria Lourdes Afiuni has been under preventive detention since December 2009, charged with "corruption, abuse of power, abetment in evasion and criminal conspiracy", related to the conditional release ordinance she had issued in favour of the banker, Eligio Cedeño.
