Human Rights and Protection of lawyers

The UIA pays special attention to the protection of human rights and the defence of their universal nature.

It works actively to protect the right of all lawyers to be able to practise their profession with full freedom and independence, without any hindrance, intimidation, harassment or interference in their professional duties.

Finally, the UIA closely follows developments in international criminal justice through its status as member of the Advisory Panel within the two International Criminal Tribunals and its participation to the work of the International Criminal Court.

This website presents UIA’s most recent activities in the field of human rights, the protection of legal professionals and international criminal law.

Arrest of two Saudi lawyers

On March 28, 2012, the Saudi Ministry of the Interior confirmed its decision to ban Waleed Abu Al Khair, a lawyer specialising in the defence of human rights, from leaving the country – for “security reasons”. Waleed Abu al Khair was informed of this ban just a few days before he was supposed to travel for a course on democracy at an American university.

Situation of Syrian lawyers

In the framework of protests which started on March 2011 in Syria, the situation has only worsened for lawyers defending human rights there.

Over the last few months, dozens of lawyers have been arbitrarily imprisoned by the security forces for publicly condemning the violent and systematic repression by the regime against peaceful demonstrators, several of whom are their colleagues.

The UIA requests the immediate release of Professor Erlinder RWANDA

The UIA has learned of the arrest of Peter Erlinder on 28 May 2010. Peter Erlinder is a US law professor and attorney, who is also the president of an association of defence lawyers at the International Criminal Tribunal for Rwanda (ICTR). He was detained while in Rwanda to defend Ms Victoire Ingabire, a candidate in the presidential elections of 9 August 2010. Ms Ingabire is under arrest and has been charged with "denying genocide, ethnic divisionism and terrorism".

Call for an end to persecution of human rights lawyers in Iran and release of Nasrin Sotoudeh. IRAN

The UIA,in a joint appeal with several NGOs,asked the Iranian authorities to interrupt the measures which prevent lawyers of human rights defenders from working freely to assist Iranian citizens.
The Iranian lawyers are subjected to various form of harassment, threats or arbitrary detention, notably lawyers Mohammad Dadkhan, Dr. Hadi Esmailzadeh, Fatemeh Soltani and Gheyrat.

The UIA expressed concern about the situation of, President of the Central African Republic Bar Association, who is wanted by the national police forces following the arson of a supermarket in Bangui in June 2010.

Mrs. Albertine Balemby, his wife, Mr Bienvenu Nganro, secretary at his law firm, and Mr Prosper Gbanga, Council Secretary of the Central African Republic Bar Association remain detained at Bossembele Prison since June 2010, in violation of the Bangui Appeal Court ruling. <BR<

The UIA introduced a request to the European Court of Human Rights in order to be authorized to submit written comments for the Golovani v. Ukraine case (N° 41716/00), related to a search in a law firm office contrary to Article 8 of the Convention.

Its intervention aimed to highlight the frame of reference followed in ruling Court case-law and to propose its application for this case.

Today many Turkish lawyers suffer judicial harassment because they are identified with their clients or the cause they are defending. Notably, lawyers who represent clients in anti-terrorism cases, in turn face prosecution for terrorism on the basis of the vague provisions on membership, support or propaganda. The UIA is concerned by the information received regarding Belorusian lawyers being subjected to attacks on legal profession practice.

Despite efforts having been made, the Minsk Bar’s authorities did not wish to meet the mission of UIA representatives which was supposed to visit Belarus in September. Under these circumstances, the mission has been suspended for the moment.

The Iraki Bar's answer to the UIA IRAQ

The UIA has questioned the Iraqi Lawyers Association about the sanctions taken in December 2010 against three lawyers in violation of their rights to a fair trial and based on questionable grounds. They were apparently sanctioned for criticizing the members of the Iraqi Bar Council whose independence is disputed.The Iraqi Bar responded to the UIA, stating that sanctions against the three lawyers were finally lifted.

From 14-22 November, the States parties to the Rome Statute of the International Criminal Court gather in The Hague for the 11th Session of the Assembly of States Parties (ASP).

Many observers will participate in discussions in particular about the legal aid system funding, the election of members of the board of directors of the Trust Fund for Victims and the difficulties regarding cooperation between the Court and the States.
