Human Rights and Protection of lawyers

The UIA pays special attention to the protection of human rights and the defence of their universal nature.

It works actively to protect the right of all lawyers to be able to practise their profession with full freedom and independence, without any hindrance, intimidation, harassment or interference in their professional duties.

Finally, the UIA closely follows developments in international criminal justice through its status as member of the Advisory Panel within the two International Criminal Tribunals and its participation to the work of the International Criminal Court.

This website presents UIA’s most recent activities in the field of human rights, the protection of legal professionals and international criminal law.

This Protocol was adopted by the United Nations General Assembly December 10, 2008.

On December, 20, 2012, the United Nations General Assembly adopted the UN Principles and Guidelines on Access to Legal Aid in Criminal Justice Systems.

These Principles mark a milestone for access to justice because it is the first international instrument exclusively dedicated to legal aid.

Proceedings against Mbuy Mbiye Tanayi

The General Public Prosecutor of Congo opened a case against Mr Mbuy Mbiye Tanayi, President of the National Bar of Congo (DRC) on the basis of anonymous information sent by e-mail.

The searches conducted in his home and law office did not reveal any information that would have proved these charges. Nonetheless, the Prosecutor referred the matter to the Bar’s disciplinary council, pleading for a disbarment motion against Mr. Mbuy Mbiye.

Judge Maria Lourdes Afiuni lawyer is sentenced to 6 months in prison.


On Tuesday night, Judge Maria Lourdes Afiuni’s lawyer, Jose Amalio Graterol, was sentenced to six months in prison for "obstruction of justice". The decision was made by Judge Victor Yepez.

The UIA calls for release of the members of the ICC detained in Libya

Alexander Khodakov and Esteban Peralta Losilla, members of the Registry; Helene Assaf, interpreter; and Melinda Taylor, a lawyer in the Office of Public Counsel for the Defence (OPCD), who were on an official mission to Libya, were arrested on June 7, 2012, in Zentane, 170 km South-West of Tripoli and placed under preventive detention for 45 days.

UIA mission to Belarus BELARUS

The UIA is concerned by the information received regarding Belorusian lawyers being subjected to attacks on legal profession practice.

Despite efforts having been made, the Minsk Bar’s authorities did not wish to meet the mission of UIA representatives which was supposed to visit Belarus in September. Under these circumstances, the mission has been suspended for the moment.

The situation of lawyers in Turkey

On 16 July 2012, a trial began involving 46 lawyers, one journalist and three jurists. Thirty-six of these lawyers have been detained since November 2011. All of them had intervened in the defence of Abdullah Öcalan and were accused of passing on information to him. They are being tried for having "participated in an illegal organisation" on the grounds of their membership of an illegal terrorist network, the "Kurdish Communities Union" (KCK).

The arrest of two Congolese lawyers

Messrs. Hervé Malonga and Gabriel Hombessa were arrested on April 9, 2012 in Brazzaville for "attacking the State's external security" and were imprisoned in the  city's detention centre, after having been kept in police custody for 24 hours. They appear to have been mistreated, both at the time of their arrest, as well as during their detention. Furthermore, Mr. Hervé Malonga was charged with the "false use of the title" of lawyer.

Concerns over an attempted assassination of human rights defender Mr Jhonel Cárdenas Castrillón

The UIA is deeply concerned because on 7 September 2012 Mr Jhonel Cárdenas Castrillón was the subject of an attempted assassination and the police response appears to have been negligent in relation to this serious crime. Mr  Cárdenas is a community leader, and the local president of the political party Polo Democrático Alternativo (Democratic Alternative Pole). The UIA met Mr Càrdenas a few days ago in Colombia. He told the UIA’s delegate about the threats he had received for his work as a human rights defender and lawyer.
