One of our members obtains important judgment from the European Court of Human Rights on 19 January 2017

English By Caroline Mecary The LABORIE spouses came to see me in 2011, because the Public Prosecutor of the First Instance Court in Nantes refused to proceed to the transcription of the birth certificates of their two children, born in Ukraine, because of suspicion of surrogacy. I therefore brought an action before the First Instance Court of Nantes who rejected my demand of transcription on 10th November 2011.

Li Chunfu was taken into police custody on 1 August 2015 as part of the “709 crackdown”, an unprecedented offensive against China’s civil rights lawyers. He was released on bail on January 5, 2017. His family found him to be in an extremely traumatized state of mind, due to paranoia and a strong sense of insecurity, as well as severely underweight. Li Chunfu is the younger brother of the lawyer Li Heping (who is awaiting trial for the alleged crime of subversion of state power).

CHOSEN SUBJECT FOR THE 2017 TORONTO CONGRESS / COMMISSION’S OFFICERS / APRIL COSTA RICA SEMINAR / LINKEDIN GROUP

Dear Members of the Foreign Investment Commission, As mentioned in our last communication, there were 3 candidate subjects to be chosen for our session next year: i. Investment in the cannabis industry, ii. Natural Resources Exploitation in your country and FDI, and iii. NAFTA as a tool for foreign investment and the issues related to the exploitation of natural resources and labour market. All three candidate subjects were very well received, but number 2, Natural Resources Exploitation in your country and FDI, was the preferred one.

The International Association of Lawyers (UIA – Union Internationale des Avocats) adopted the Basic Principles on the Status of Refugees on Friday, October 28, 2016, during its annual congress in Budapest. These principles are intended to contribute actively to the dialogue and actions undertaken in relation to the “migration crisis”. In order to obtain as broad a consensus as possible, UIA proposes that the global community of lawyers also adhere to these principles.

The UIA Deplores New Repressive Measures against the Legal Profession in Turkey

The Union Internationale des Avocats (UIA - Internationale Association of Lawyers) is outraged by the repressive measures against the legal profession announced by the Turkish Government on October 29, 2016. According to press reports, the Turkish Government will no longer permit Turkish lawyers representing alleged “terrorists” to meet with their clients in private, but instead will require that a prison guard be present during all such meetings. In addition, all attorney-client conversations will be recorded by the Turkish authorities and all documents exchanged between lawyer and client will be inspected by the Turkish authorities, who also will have the right to bar lawyers from visiting such clients at all for periods of as much as six months. These repressive measures constitute a grave violation of Turkey’s obligations as a member of the Council of Europe, of the UN Basic principles on the Role of Lawyers (Havana 1990) and of the European Convention on Human Rights which remain applicable notwithstanding the declaration of Tukey to suspend it due to the status of emergency. Moreover, they reflect the apparent determination of the Turkish Government to use the current “state of emergency” as an excuse to violate one of the most fundamental principles of the Rule of Law: the right of an accused to the confidential assistance of an independent lawyer. Pending careful review of the decrees, the UIA wishes to remind the Turkish authorities of Turkey’s obligations under international law. These decrees appear to violate the fundamental rights to effective legal representation, fair trial and due process, as well as other fundamental rights which Turkey has agreed to uphold, including those set forth in the International Covenant on Civil and Political Rights and the UN Basic Principles on the Role of Lawyers. The UIA calls upon all Governments, and all Bars, Law Societies and legal associations throughout the world, to make clear to the Government of Turkey that these repressive and authoritarian measures must be withdrawn, and that the continued deprivation by the Turkish Government of the fundamental rights of Turkish citizens and its continued persecution of the lawyers who defend those rights will have severe consequences for Turkey’s political and economic future. The UIA will continue to monitor closely the situation in Turkey, and will continue to speak out in defence of the rights of Turkish citizens and the lawyers who protect them.
