Human Rights and Protection of lawyers

The UIA pays special attention to the protection of human rights and the defence of their universal nature.

It works actively to protect the right of all lawyers to be able to practise their profession with full freedom and independence, without any hindrance, intimidation, harassment or interference in their professional duties.

Finally, the UIA closely follows developments in international criminal justice through its status as member of the Advisory Panel within the two International Criminal Tribunals and its participation to the work of the International Criminal Court.

This website presents UIA’s most recent activities in the field of human rights, the protection of legal professionals and international criminal law.

On June 25 2014, a jury of 24 European lawyers, representing bars from Paris, Bordeaux, Amsterdam, Berlin, Brussels, Geneva, Rome, Luxembourg, and members of the European Bar Human Rights Institute (IDHAE - l’Institut des Droits de l’Homme des Avocats européens) and the Union Internationale des Avocats (UIA – International Association of Lawyers), awarded the 19th Ludovic Trarieux Prize to Mahinour el-Masry, an Egyptian lawyer.

Arrest and prosecution of several lawyers at the ICC: the UIA reiterates the guarantees that are applicable

On 20 November 2013, Judge Cuno Tarfusser, the single Judge of Pre-Trial Chamber II of the International Criminal Court (ICC), issued four warrants for the arrest of Aimé Kilolo Musamba, the lead counsel of Jean-Pierre Bemba Gombo, Jean-Jacques Mangenda Kabongo, a member of his defence team, Fidèle Babala Wandu, a member of Jean-Pierre Bemba Gombo’s political party, and Narcisse Arido, a defence witness.

Colombia Caravana - UK Lawyers Group

The Colombian Caravana is an international network of jurists supporting human rights lawyers in Colombia.

It is a pioneering initiative based on solidarity, education and advocacy, founded in 2008 upon request from the Colombian Association of Human Rights Lawyers (ACADEHUM). Caravana members work voluntarily to support Colombian human rights lawyers, so that they can work without threat to their lives.

Turkey. The President of the Istanbul Bar Association, Ümit Kocasakal, and the Nine Bar Council's Members Acquitted

Mr. Ümit Kocasakal, President of the Istanbul Bar Association, and nine members of the Bar Council   were acquitted on February 24, 2014. They had been charged with "attempting to influence a judge" after intervening in the Balyoz  (“Sledgehammer”), trial in April 2012, at which time they requested  the judges to respect the rights of the defence.

UIA Mediation in Equatorial Guinea - Disciplinary sanctions against Mr. Ponciano Mbomio lifted

The UIA welcomes the success of the mediation efforts it made in January 2014 with the Equatorial Guinea Bar Association. Conducted by Mr. Fernando Tonim, the mediation led to the immediate lifting of the two-year suspension order issued by the Bar against Mr. Mbomio on 27 April 2012.

Death Penalty Sentence of 529 Egyptians Violates Right to Fair Trial

On March 24, 2014, 529 Egyptians were sentenced to death on charges related to the events leading to the ousting of the Government of President Mohammed Morsi in 2013. At least 600 more individuals are currently on trial for similar charges.

According to the information received about the Egyptian sentences, numerous procedural irregularities occurred during the proceedings, such as unclear or insignificant charges, limited access to lawyers, trials in absentia.

UIA Comments to the Office of the Prosecutor of the ICC Draft Policy Paper on Sexual and Gender Based Crimes

On February 7, 2014, the Office of the Prosecutor of the International Criminal Court (ICC) published a Draft General Policy Document on sexual and sexist crimes, inviting comments on the draft.

In a letter dated February 23, 2014 the UIA had shared its observations, especially about the involvement of legal representatives of victims and witnesses, both during the inquiry and at the start of proceedings and during the  trial.

The UIA strongly protests against the decision by the Bujumbura Court of Appeal’s pronouncing the immediate and binding disbarment, notwithstanding any appeal of the Bujumbura Bar President, Mr. Isidore Rufyikiri, both with regard to the reasons allegedly justifying the legal proceedings and the manner in which the legal proceedings were conducted.

January 24 – International Day of Endangered Lawyers – Call to all lawyers to support their Colombian colleagues

Attacks on, and assassinations of, Colombian lawyers are a daily reality: since 1991, more than 400 lawyers have been killed in Colombia.

This means that, on average, a lawyer is killed every month in Colombia.

In the first eight months of 2013, 11 lawyers were killed in the region of Valle del Cauca alone.

Aside from murder, lawyers are also threatened and harassed. Between 2002 and 2012, there were more than 4,400 aggressions against lawyers.

The UIA co-signs a press release regarding pre-trial detention of Muharrem Erbey

The UIA has co-signed a press release denouncing the protracted and unjustified detention of Turkish lawyer Mr. Muharrem Erbey, Vice President of the Human Rights Association (İnsan Hakları DerneğiİHD), former President of the İHD's branch office in Diyarbakır and recipient of the Ludovic-Trarieux International Human Rights Prize for 2012. The press release was distributed on January 10, 2014.

Award-winning Syrian human rights defender and writer Razan Zaitouneh, along with her husband, Wa’el Hamada, and two colleagues, Nazem Hamadi and Samira Khalil, all of whom are lawyers or human rights defenders, were abducted by unknown individuals on 9 December 2013 from a joint office for the Violations Documentation Center (VDC) and the Local Development and Small Projects Support (LDSPS) in the Damascus suburb of Douma.

The 18th Ludovic Trarieux International Human Rights Prize, attributed to Kazakh lawyer Vadim Kuramshin, was delivered to his mother, Olga Koltunova, by Christiane Féral-Schuhl, during a ceremony that took place on Thursday December 5, 2013 at the Maison du Barreau in Paris .
