Concern for the Latest Legislative Reforms Reorganising the Justice Jystem

On July 15, 2017, despite the opposition of the Polish legal community and civil society, two new laws reorganising the judiciary in Poland were adopted by Parliament.

The first law concerned the reform of the National Judicial Council and increased Parliament's influence on the judiciary, including that 15 of the 25 Council members – previously appointed by judicial assemblies – be appointed by the Lower House of Parliament (Sejm).

Access to an independent lawyer is a requirement for the adequate protection of fundamental freedoms and human rights. Bars and professional lawyers’ associations must be the custodians both of the independence of lawyers as well as that of the association itself.

Profound Concern about the Recently‐proposed Changes to the Legal Profession Act of 1976 (the “LPA”)


At the end of May 2016, the President of the Malaysian Bar, Mr. Stephen Thiru, indicated that the government of Malaysia proposed several changes to the Legal Profession Act of 1976 (the “LPA”). The proposed amendments are scheduled to be tabled in the Dewan Rakyat during the next Parliamentary session from October to November 2016. President Thiru alerted to the potential dangers these amendments posed to the independence of the Bar.  Among the proposed changes:

The CCBE and the UIA have issued a joint statement on the contents of Action 12 (Mandatory Disclosure Rules) of the OECD Action Plan on Base Erosion and Profit Shifting.

 

Both organizations strongly oppose any option that would place an obligation of disclosure of tax schemes on lawyers acting as legal counsel in tax matters, and thus in order to protect the fundamental principles of client confidentiality.

Tapping of Dutch lawyers by the national security service AIVD, was illegal. Dutch Court forbids the State to tap lawyer-client communication. 

The right to communicate freely and unhindered with an attorney, the professional legal privilege, may only be infringed in exceptional circumstances and under strict safeguards.

Lawyers Concerned about the ICC Registry Re Vision Project

On November 17, 2014, the UIA sent letter to the Registrar expressing grave concern from lawyers about the Registry Re Vision Project (in French).

In the project the Office of Public Counsel for the Defense (OPCD) will be suppressed and replaced by a new body (merging the OPCD and the Counsel Support Section) which would not be independent from the Registry. 

The UIA calls for a comprehensive consultation process with the Registry on these issues.
