Human Rights and Protection of lawyers

The UIA pays special attention to the protection of human rights and the defence of their universal nature.

It works actively to protect the right of all lawyers to be able to practise their profession with full freedom and independence, without any hindrance, intimidation, harassment or interference in their professional duties.

Finally, the UIA closely follows developments in international criminal justice through its status as member of the Advisory Panel within the two International Criminal Tribunals and its participation to the work of the International Criminal Court.

This website presents UIA’s most recent activities in the field of human rights, the protection of legal professionals and international criminal law.

Nigeria: Call for an Official Moratorium on Death Penalty

The UIA expresses concern after reports of the statement by the Attorney General of Lagos State during a press briefing on April 18 indicating that the state government would soon start signing execution.

Several ONG have expressed serious concerns as to whether many of the inmates on death row have received a fair trial. The practice of coerced ‘confessions’ rather than investigations, and statements signed under torture has been demonstrated in several death penalty cases in Nigeria.

Threats, intimidation and harassment against lawyers engaged in the defence of human rights and sensitive cases, including those that are judicial in nature; the identification of lawyers with their clients or with their clients’ cases; the wrongful exploitation of professional licence delivery or renewal systems; attacks on the freedom of expression of lawyers and the independence of bars – these are some of the situations that the Protection of Lawyers' Team has been followed closely in 2015-2016 across the world.

Murder of Human Rights Lawyer Willie Kimani


On June 30 2016, Mr. Willie Kimani, lawyer at the NGO International Justice Mission; Josphat Mwendwa, one of Mr. Kimani’s client; and their taxi drive, were found  dead on the bank of a river 73 km north-east of Nairobi. The three men went missing on June 23, after a court appointment at Makovo Law Court, 60 km South-east of Nairobi. It was reported that they have been  abducted by administration police officers.

Willie Kimani represented Mr. Mwenda in a case against a Kenyan police officer who was accused of corruption.

Violation of the rights to defence: Prosecution of Lawyers who are Members of the Association Ozgurlukcu Hukukcular Dernegi (OHD)

On March 16, 2016, lawyers İrfan Arasan, Ayşe Acinikli, Hüseyin Boğatekin, Şefik Çelik, Adem Çalışçı, Ayşe Başar, Tamer Doğan, Ramazan Demir and Mustafa Ruzgar were arrested. Their houses in Istanbul were raided by the police, in the course of an anti-terrorism operation that targeted more than 80 individuals in several Turkish cities.

Support to lawyers Julien Brel and Benjamin Francos, and to the Toulouse Bar Association

On March 7, 2016, lawyers Julien Brel and Benjamin Francos were summoned for interrogation by the Inspection générale de la police nationale (IGPN – General Inspection of National Police) following a complaint lodged by police officers for « rebellion and false allegations”. A group of lawyers, leaded by Ms. Anne Fauré, President of the Toulouse Bar Association, gathered in front of the Toulouse Police Headquarters to support their colleagues.

Murder of Lawyer Héctor Sáchez Lozada

On January 22, 2016, lawyer Héctor Sánchez Lozada was murdered in the city of Maturín, in the state of Monagas. He was travelling to meet another lawyer. Currently, the reasons for the crime and the perpetrators remain unknown.

Mr. Sánchez Lozada was a human rights lawyers and a member of the Human Rights Commission of the Federation of Venezuelan Bar Associations in the state of Monagas.

The UIA Condemns the Murder of Lawyer Jean Kisumbule Muteba

On February 21, 2016, Mr. Jean Kisumbule Muteba, a lawyer at the Bar Association of Kinshasa/Gombe, was murdered at Bandalungwa, Kinshasa, by unidentified individuals. The motivation for the crime remains unknown.

Mr. Edouard Mukendi Kalambayi, President of the Bar Association of Kinshasa/Gombe, called on national authorities to investigate the crime and bring the responsible individuals to justice. The UIA sent a letter to President Mukendi Kalambayi to express its support ( see attached).

Charges against Human Rights Lawyer Khin Khin Kyaw

Ms. Khin Khin Kyaw is a human rights lawyer and member of a legal team representing more than 50 detained student protesters who participated in protests in Letpadan to oppose Myanmar’s National Education Law.

Ms. Khin Khin Kyaw was charged with disrupting the court proceeding, under Section 228 of the Penal Code. The charge is related to the proceeding at the Thayawaddy Township Court on September 2015, when she was representing legal interests of the detained student protesters.

Concerns about the Situation of Mr. Arão Bula Tempo

On October 22, 2015, Mr. Arão Bula Tempo, a lawyer and President of the Angola Provincial Bar Association Council in Cabinda, was charged with attempt to “collaborate with foreigners with a view to coercing the Angolan State” (which bears a maximum sentence of 5 years imprisonment) and rebellion (a maximum sentence of 12 years imprisonment).

He was arrested on March 14, 2015 and was released conditionally two months later.

The UIA Condemns Murder of Lead Lawyer Tahir Elçi, President of the Diyarbakir Bar Association

The UIA is deeply shocked by the murder of prominent lawyer Mr. Tahir Elçi, President of the Diyarbakir Bar Association and a leading human rights activist.

According to reports, Mr. Elçi was shot in the head and killed on Saturday November 28, shortly after making a press statement at the Diyarbakir province’s central Sur district. Two police officers were also killed and several people were injured in the attack. At the time of this writing, all the factual circumstances surrounding the case remain unclear.

Re-arrest of 2014 Ludovic Trarieux Human Rights Prize Winner Mahienour El-Massry

The UIA deplores the situation of Human Rights Lawyer and 2014 Ludovic Trarieux Prize recipient, Mahienour El-Massry who has been re-arrested on Monday, May 11.

The order for arrest was delivered by the Alexandria Court during the appeal of the case in which Ms. El-Massry, Mr. Youssef Shaban, Mr. Mohamed Ramadan, Mr. Loay Mohamed Abdel Rahman and eight other activists were sentenced last February to two years in prison

Intervention in support of the Croatian Bar Association

On March 23, 2015, Lawyer Vlatko Vidakovic was shot down by one of his former clients in his office at Osijek, Croatia. This case seems not to be an isolated one, and according to information provided by the Croatian Bar Association, nine lawyers and one legal trainee have been killed in Croatia since 1972 under similar circumstances. During the same period, 15 lawyers have been subject to physical attacks, including having explosive devices planted in their premises, fires set to their flats and other similar offences.

Bulgarian Lawyer Mr. Ventislav Petrov Tochkov Acquitted


The UIA has been informed that the lawyer, Ventislav Petrov Tochkov, has been discharged by a final ruling of the Supreme Court on August 25, 2015.

Mr. Tochkov had been sentenced to an administrative fine and the payment of damages for defamation on September 18, 2014. The conviction stemmed from comments made by the lawyer in a defence plea in the course of representing his client.

January 23, 2015 – Day of the Endangered Lawyer – UIA's Solidarity with Philippine Lawyers

On January 23, 2015, the International Day of the Endangered Lawyer, lawyers from all over Europe protested in solidarity with Philippine lawyers who are threatened and even killed because they defend the rights of the poorest and work on cases of human rights violations. 

Since 2001, 41 Philippines lawyers has been murdered, nine (22%) of whom were directly involved in handling human rights cases or issues.
